Unconditional victory for lawyer Irina Uradovskikh in the “pension case”

Refusal to grant a pension is not a unique situation. From 2019 to 2024, the Social Fund of the Russian Federation (formerly the Pension Fund of the Russian Federation) skillfully used the provisions on the “transition period” and, on formal pretexts, refused to grant an early insurance pension.

On the date of the first application for a pension, our principal had the required pension coefficient, general and special insurance experience. Moreover, he was awarded state awards and had worldwide recognition for the development and implementation of unique methods for treating congenital anomalies of children.

However, the Pension Fund of Russia considered that the “experience” of the candidate of medical sciences was not enough. Military service as a doctor at a medical station, work as a surgeon in the territory of the former republic of the USSR, medical activity of an operating surgeon at a research institute cannot be included in medical experience. Later, the Pension Fund of the Russian Federation included these periods, but still refused pensions, now citing the transition period.

The lawyer did a huge amount of work collecting evidence, in particular, at the lawyer’s request, confirmation of medical experience was received from the Archival Funds of the Republic of Uzbekistan, confirmation of payment of insurance premiums by a foreign state, and a statement of claim was prepared with 3 options for calculating special experience, consisting of 56 periods.

The courts of the first and second instances agreed with our arguments, the actions of the Pension Fund of Russia were declared illegal. The principal was assigned a pension from the date of the first application, which means a lump sum payment for the past 5 years.
