Landmark Court Ruling: Commentary by Lawyer Irina Uradovskikh

St. Petersburg has seen its first court ruling on a claim against a kick-sharing company whose electric scooter, operated by a food delivery worker, struck a pedestrian. This precedent-setting case is being actively discussed in the legal and business community.

Irina Uradovskikh, an lawyer at Iusland Law Offices, commented on the situation for Business FM St. Petersburg:

"As I understand it, the ruling was based on the principle that liability for harm caused rests with the person who directly caused the harm. Perhaps, when filing the lawsuit, the claimants also wanted to hold the kick-sharing company liable, assuming it was the employer, in order to apply different legal provisions. Our Labor Code states that an employer bears responsibility for harm caused by its employee; however, in this case, the provisions of the Labor Code were not applicable."

This case raises important questions about the delineation of liability and how the law will adapt to the new realities of business and the use of personal mobility devices.
