Expert opinion of Ekaterina Dmitrikova within the framework of St. Petersburg International Legal Forum 2024

Expert opinions on key topics of the business program of the St. Petersburg International Legal Forum 2024 prepared by Ekaterina Dmitrikova, Counselor of the Iusland Law Office, were awarded with gratitude of the Roscongress Foundation.

The conclusion, prepared as a result of the session “Systematization of regional and municipal legal acts at the present stage: issues of ensuring the unity of the legal space”, identifies a number of problematic issues, the solution of which is necessary to ensure the unity of the legal space. On the one hand, there is a high normative activity of regions and municipalities - more than 150 thousand regional and 860 thousand municipal normative acts are adopted annually in Russia, on the other hand, the adoption of municipal acts is dependent on the timely adoption of a regional law.

With regard to the issue of defining the model of state control (supervision) over the activities of local self-government bodies, Ekaterina Dmitrikova emphasized that local self-government bodies are control (supervisory) bodies and at the same time-controlled persons.

The expert noted that granting local self-government bodies the status of controlled persons (rights of a legal entity) cannot serve as a convincing argument in favor of the fact that the activity of a public authority subject is controlled according to the rules of a participant of civil turnover.

The following recommendations were formulated as part of the expert opinion:

1. Consider the issue of establishing deadlines for the adoption of laws in constituent entities of the Russian Federation and liability for violation of said deadlines in cases where federal law provides for the adoption of municipal legal acts in accordance with regional law.

2. When developing a model of state control (supervision) over the activities of local self-government bodies, take into account the currently implemented mechanisms of control and supervision over the activities of local self-government bodies. It is advisable to use certain tools that are applied within the framework of state control (supervision) in relation to the activities of controlled entities that are not related to the exercise of authority.
