Dmitry Obukhovskiy notes that constant participation in civil and criminal proceedings related to causing harm to health, poor-quality provision of medical services, and violation of the rights of patient-consumers allows one to state with confidence that the most severe consequences of poor-quality medical interventions are associated with the insufficiency of knowledge, skills, and experience of medical workers. But let us remember that the combination of these characteristics forms the term - COMPETENCE.

In this case, at least two of the three components of COMPETENCE - knowledge and skills - are the result of the process of obtaining higher and postgraduate education.

Let us refer to Part 4 of Article 82 of the Federal Law No. 273-FZ of December 29, 2012 "On Education in the Russian Federation", which implies that the mastery of postgraduate education programs is carried out by involving medical workers in the medical activities carried out by that organization. It follows that all advanced training and retraining programs for medical workers that have been and are being implemented by organizations having a license only for educational activities do not meet this criterion.

Over the past 10-15 years, there has been a steady trend of increasing the amount of compensation for harm caused to health and compensation for moral damage, both in civil lawsuits considered in courts of general jurisdiction and in civil lawsuits considered within criminal proceedings. Their amounts, reflected in court decisions, sometimes reach seven-figure numbers.
