Iusland Law Office’s advocate Aleksandr Mamyshev commented on the article “Violence against officials: to get an acquittal”, published by the leading Russian legal news portal “Pravo.ru”

On December 24, “Pravo.ru” published an article entitled “Violence against officials: get an acquittal: to get an acquittal”, in which Iusland Law Office’s advocate Aleksandr Mamyshev expressed his expert opinion.

According to statistics, the number of acquittals under the Article 318 of the Criminal Code is an average of about 0.10% over the past year and a half. The case, examined in this article, confirms the rarity of acquittals under this article once again.

One of the circumstances, that served as the verdict, was the inclusion in the case file of videos made by the accused and the victim. They proved the fact that the accused did not use violence against a representative of the government, which prevented him from carrying out legal actions. According to experts, audio and video recordings should be shared and investigated along with other evidence. “According to Art. 14-15 of the Code of Criminal Procedure, due to the adversarial nature of the parties, the prosecution has an obligation to refute the records submitted by the defense. For example, through phonoscopic examinations and comparison with other evidence”, says Aleksandr.
