Advocate Vladislav Salita commented on the bill that will change the rules of applying claims for the protection of honour, dignity and business reputation

On May 27th in the article “The Duma was requested to change the rules of applying the lawsuits for protection of honour”, advocate of the Iusland Law Offices Vladislav Salita left a commentary for “Pravo.ru”.

The authors of the bill assume that applying changes will make implementing constitutional rights easier for the public. The bill suggests to let people apply claims for protection of honour, dignity and business reputation to courts at the residence or the place of stay of the claimant . Currently by law a claim has to be applied at the residence of the defendant or the organization’s location. The bill was suggested to the Duma by the Supreme Parliament of the Republic of Tyva.

«The norm under discussion is similar to the norms, established by the law “On the protection of the Rights of the consumers”, where alternative jurisdiction is provided and the claimant almost always applies to the court at their residence”, noted Salita.

However, there are positive side of the bill:

«The situation can be viewed from a different perspective. The point is that the web-resources’ legal address and the actual address are located in different places and regions, so notification and execution issues appear. In this case the bill is a huge breakthrough and makes it possible to literally make people responsible for slander and insults on the Internet”.
