In October the Act on Criminal Responsibility was passed for refusal to hire people near retirement age and fire them. However, without the new Act there are a lot of reasons in the Criminal Code to take the employer to court.

«On practice, cases on Criminal Code art. 145 are hardly prosecuted, because of the difficulty of proving actual motives of refusal of recruitment or dismissal. More often questions of legality of recruitment or dismissal are settled in the civil disputes. In my opinion it is the most effective way to protect rights for workers and employers», - commented Elena.
