Iusland Law Offices” partner and advocate Maria Fedosova commented on disputes arising from the receipt of preferential taxation introduced in connection with coronavirus restrictions.

22.12.2020

In July of this year, within the framework of assistance to the affected participants in economic activities, companies received the right to reduce the property tax by fifty percent. This privilege was extended only to enterprises with certain types of activity in accordance with the General Classifier of Foreign Economic Activity (OKVED). In the circumstances that arose, the Arbitration Court of St. Petersburg and the Leningrad Region left the application filed by the organization without consideration, citing non-compliance with all the mandatory conditions for the application of the privilege.

Maria Fedosova, Iusland Law Offices” partner, comments: “The court noted in the company's statement not the establishment of a legal fact, but the existence of a dispute, the essence of which was actually reduced to taxation. Therefore, it made such a (negative) decision. The dispute is not resolved, but apply for a tax reduction in the course of action proceedings ". More details - www.dp.ru
