All commercial disputes between companies must be settled in arbitration courts. But the Russian reality is such that quite often such proceedings turn into a criminal plane. It happens when new investors or shareholders appear who begin conflicting with skilled participants, with an ordinary desire to cause maximum troubles to the counterparty.

Such cases are not uncommon in bankruptcy cases too. “A criminal case against the beneficiaries of the debtor significantly increases the chance of bringing them to subsidiary liability,” explains Elena Legashova, Iusland Law Offices` Managing partner.

It is impossible to protect oneself from such criminal risks and procedures completely. “… And if the conflict has reached the level of a criminal case, one should never hope that “ the investigator will figure it out on his own ”. Such tactics show in practice their ineffectiveness and lead to disastrous consequences for the accused and for his business,” sums up Elena.
