The Judicial Collegium for Economic Disputes of the Supreme Court recognized the jurisdiction of arbitration courts to consider disputes over the protection of the business reputation of homeowners' associations, which caused controversy among lawyers.

Elena Legashova,Iusland Law Offices’ Managing Partner, commented on the legal position of the Supreme Court of the Russian Federation, calling it consistent with the procedural norms. “For practice, it is more important to analyze the concept of “other economic activity” and the correlation of this concept with business activity, which is carried out by the Supreme Court in its definition. The court clearly defines, that the term “economic activity” is not identical with entrepreneurial activity, as well as that a homeowners' association, being a non-profit organization, carries out economic activities, and disputes about protecting the business reputation of a homeowners associations are subject to arbitration,” Elena said.
